LOS ANGELES TOURISM SWEEPSTAKES OFFICIAL RULES
(the “Sweepstakes”)
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN.
1. Eligibility
The Sweepstakes is open to persons over the age of 18 who are current U.S. residents living in the 50 U.S. States, excluding, the U.S. Virgin Islands, U.S. Military installations in foreign countries, and all other U.S. territories and possessions and where restricted or prohibited by law. Please note that if the prize listed does not clearly state transportation to and from the prize location or venue is included, and/or constitutes an event, tickets, or requires any winner to be in the Los Angeles area, transportation is never provided. Entrants must have access to the Internet. Employees of Sponsor its advertising and promotion agencies, and any other entities participating in the design, promotion, marketing, administration or fulfillment of Sweepstakes, as well as each parent corporation, subsidiary and affiliated company and their immediate families (defined as spouse, mother, father, sisters, brothers, sons, daughters, uncles, aunts, nephews, nieces, grandparents and in-laws, regardless of where they live) and members of their households (whether or not related), are ineligible to participate in any Los Angeles Tourism and Convention Board Sweepstakes.
Participation in the Sweepstakes and claiming a prize constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor and Administrator’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.
2. Sponsor and Administrator
Sponsor: Los Angeles Tourism and Convention Board, 633 West 5th Street, 18th Floor, Los Angeles, CA 90071.
3. Timing
Sweepstakes begins at 12:01 a.m. California Time (“PT”) on date and ends at 11:59 p.m. PT on date (“Sweepstakes Period”), regardless of Daylight Savings Time. Sponsor is the official time- keeper for this Sweepstakes.
4. How to Enter
To enter, visit discoverLA.com during the Sweepstakes Period listed above to subscribe to the LA Tourism newsletter. You will be asked to submit your name and email for a chance to win the prize, as outlined below. You must maintain your subscription up to and including the Sweepstakes drawing date in order to be eligible to win a prize, after which time, you may unsubscribe using the information contained in any communication.
Multiple Entries. Limit of one (1) entry per person. Proof of submission of an entry does not constitute proof of receipt of entry by Sponsor or its agents. Sponsor reserves the right to void all entries made through any third-party website or service, or through any robotic, automatic, mechanical, programmed or similar entry duplication method, and to disqualify any individual using such a website/service or entry method. Sponsor is not responsible for technical difficulties or Internet service disruptions or other equipment or service issues which might affect an online user’s ability to enter the Sweepstakes or the ability of Sponsor to notify the Winner through email message. Facsimiles or mechanical reproductions will not be accepted, and entrants may not use any other device or artifice to enter in excess of the number of entries allowed. All entries become the property of Sponsor and will not be returned.
5. Winner Selection
Prize Winner (Winner”) One (1) winner, from among all eligible entrants will be randomly selected at the conclusion of the Sweepstakes with final selection occurring on or about February 3, 2025.
The drawing will be conducted by Sponsor or a representative of Sponsor, whose decisions, along with the decisions of Sponsor, will be final and binding in all matters relating to this Sweepstakes. Odds of winning a prize will be determined by the total number of eligible entries received through the entry method. The awarding of the prize is subject to verification of potential Winner’s eligibility. The Winner will be notified on or around [February 3, 2025], or shortly thereafter, by the email used in the entry form, and will be asked to complete required verifications, in order to receive the prize. The Winner will have 48 hours to respond to the initial email, and three (3) days to respond to follow-up notification email to accept the prize. Before being declared a winner, unless prohibited by law, the potential Grand Prize Winner will be required to execute a declaration or affidavit of Eligibility/Liability & Publicity Release (“Declaration”), sent with the e-mail notification in order to formally accept the prize. If any prize notification is returned as undeliverable, or if the potential Winner fails to complete the prize claim document within the stated time period, or if the potential prize Winner cannot accept the prize as stated, or if Sponsor, in its sole discretion, deems the potential Winner ineligible to receive the prize for any reason, the corresponding prize will be forfeited in its entirety and awarded (time permitting) to an alternate Winner in a random drawing from among the remaining entries received. In the event of a dispute as to the winner it will be considered the authorized account holder of the email address submitted at time of entry. The authorized account holder is the natural person who is assigned to the email address by an Internet access provider, online service, or other organization that is responsible for assigning email addresses. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
6. Verification of Potential Winners
Winning a prize is contingent upon fulfilling all requirements. This is a taxable event. The Winner will be required to provide a Social Security number as outlined in this Rules, along with any evidence of eligibility reasonably requested to verify eligibility. In the event a potential is disqualified for any reason, Sponsor may at its discretion award the applicable prize to an alternate Winner by random drawing from among all remaining eligible entries.
Unless otherwise prohibited by law, prizes are non-transferable, and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the prize for one of equal or greater value for any reason. Any and all guarantees and warranties are subject to the manufacturer’s terms and conditions, and Winner agrees to look solely to such entity for any such warranty or guarantee claim.
7. Prize
Grand Prize:
One (1) Grand Prize will be awarded. Winner will receive a $1,000 American Express gift card and two (2) nights at a Los Angeles hotel selected by Sponsor. Gift card may be subject to restrictions by card issuer.
Winner is not entitled to any surplus between the actual retail value of the prize and the stated value. If, for whatever reason, Sponsor is unable to provide any prize element, no compensation or substitution will be provided, unless prohibited by law.
The approximate retail value (“ARV”) of the Hotel portion is $600. The ARV of the gift card is $1000. The total ARV for the Grand Prize is $1,600. Actual value may vary and Winner is not entitled to a difference between actual and estimated value. The total ARV is $1,600.
The prize offered and awarded is not redeemable for cash. Prize details not specified herein shall be determined solely by Sponsor. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. Sponsor will not replace misplaced, lost, or damaged cards.
8. Prize Conditions:
Winning a prize is a taxable event. Taxes are the sole responsibility of potential Winners, and potential Winners who are U.S. residents will be issued an IRS Form 1099 for the ARV of any awarded prize. Winner waives the right to assert as a cost of winning a prize any and all costs of verification and redemption to redeem said prize and any liability which might arise from redeeming or seeking to redeem said prize. All federal, state or other tax liabilities (including income taxes) arising from any winnings will be the sole responsibility of each winner who accepts a prize. Except where prohibited by law, the winner’s entry and acceptance of the prize constitutes permission for Sponsor and/or any related or affiliated companies (collectively “Sweepstakes Entities”) to use said winner’s name on air, and in some cases, his or her photograph, likeness, statements, biographical information, voice, and city and state address for promotional or advertising purposes in connection with Sponsor generally. All entries are subject to verification prior to awarding of prizes. Eligibility, age, and claims made by the Selected Entrant also are subject to verification prior to awarding of prizes.
9. Entry Conditions and Release
Except where prohibited by law, by entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of Sponsor and Administrator, which are binding and final in all matters relating to this Sweepstakes; (b) except where prohibited, release and hold harmless Sweepstakes Entities, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes, and all of their respective affiliates and related entities and each of their respective officers, directors, agents, vendors, employees and other representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, illness, death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Sweepstakes, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) except where prohibited, indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an entrant’s participation in the Sweepstakes and/or entrant’s acceptance, use or misuse of prize.
Any personally identifiable information collected during an entrant's participation in the Sweepstakes will be used to administer the sweepstakes. In addition, entrants may receive email correspondence from, or on behalf of Sponsor and its affiliates, to promote products and services to Entrants. Sponsors and affiliates use reasonable commercial efforts to comply with Federal CAN-SPAM guidelines and to supply information to entities that comply with CAN-SPAM guidelines, and Entrants may subsequently opt-out of receiving further emails by following the opt-out instructions contained in the email. 10. Publicity
Except where prohibited, participation in the Sweepstakes constitutes Winner’s consent to Sponsor’s and its agents’ use of Winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any medium, worldwide, without further payment or consideration.
11. General Conditions
Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, delayed, illegible, garbled or damaged entries, prize claims, email or mail; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries or prize claims, the announcement of the prize or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Sponsor or Administrator reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor or Administrator’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor or Administrator in its sole discretion. Administrator reserve the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Administrator reserves the right to seek damages from any such person to the fullest extent permitted by law. Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Entry in the Sweepstakes constitutes an entrant’s full and unconditional agreement to abide by and accept the terms and conditions of these Official Rules.
The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; (d) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. One prize per person only. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
12. Choice of Law and Disputes
By entering the Sweepstakes, entrants agree this Sweepstakes are governed by laws of the State of California, and submit to the jurisdiction of the state courts in Los Angeles County, California.
