LA TOURISM LONDON SWEEPSTAKES 2023 OFFICIAL RULES

(the “Sweepstakes”)

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. OPEN ONLY TO ELIGIBLE LEGAL RESIDENTS OF ENGLAND WHO ARE THE AGE OF MAJORITY AT THE TIME OF ENTRY. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. THIS SWEEPSTAKES IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH ANY SOCIAL MEDIA PLATFORM. 

1. Eligibility 
The Sweepstakes is offered only to legal residents of England who are at least the age of majority at the time of entry and have the ability to travel to the United States, including a valid passport and other information necessary to travel to Los Angeles, CA. Employees, officers, directors, representatives, and agents of Sponsor, including airlines and other prize providers, Administrator, and each of their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies (collectively, “Promotion Entities”) and each of their immediate family members (e.g., spouse, parent, child, sibling, and their respective spouses and the “steps” of each, regardless of where they reside) and persons living in the same household of each, whether or not related, are not eligible to enter or win. All applicable federal, state, and local laws and regulations apply. Void where prohibited or restricted by law. Unless barred by law, participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor and Administrator’s decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein. 

2. Sponsor and Administrator
Sponsor: Los Angeles Tourism and Convention Board, 633 West 5th Street, 18th Floor, Los Angeles, CA 90071.

3. Timing
Sweepstakes begins at 12:01 a.m. California Time (“PT”) on [Tuesday, February 28], 2023 and ends at 11:59 p.m. PT on [Tuesday April 18], 2023 (“Sweepstakes Period”). Sponsor is the official time- keeper for this Sweepstakes.

4. How to Enter 

Enter via Instagram. You must have an Instagram account.  You may create an Instagram account for free by accessing Instagram at http://Instagram.com and following the instructions to create an account for free.  Information you provide to Instagram to open an account is subject to Instagram’s privacy policy.  Your account may not be private.  Once you have an Instagram account, to enter this Sweepstakes:

Follow both @discoverla and @saatchi_gallery. Create an LA-inspired post at BEYOND THE STREETS LONDON bearing the hashtags #DiscoverLA, #Saatchi2LA and comment with your dream activity in Los Angeles.  Please, no profanity or maligning of others.

Any social posts made from a private account will not count as valid entries. You must have a non-private account to enter and have your account privacy setting to ‘Off’ to enter the Sweepstakes.

Multiple Entries.  Limit of one (1) entry per social media account, regardless of method of entry.  Multiple Entries, regardless of method of entry, will not be considered. Proof of submission of an entry does not constitute proof of receipt of entry by Sponsor or its agents. Sponsor reserves the right to void all entries made through any third-party website or service, or through any robotic, automatic, mechanical, programmed or similar entry duplication method, and to disqualify any individual using such a website/service or entry method. Sponsor is not responsible for technical difficulties or Internet service disruptions or other equipment or service issues which might affect an online user’s ability to enter via social media and qualify or the ability of Sponsor to notify the Winner through social media direct message. Facsimiles or mechanical reproductions will not be accepted, and entrants may not use any other device or artifice to enter in excess of the number of entries allowed. All entries become the property of Sponsor and will not be returned. 

5. Winner Selection 
Prize Winner (“Winner”)
One (1) winner, from Instagram entries, will be randomly selected from all eligible entries at the conclusion of the Sweepstakes with final selection occurring on or about April 18, 2023. 

The drawing will be conducted by Sponsor or a representative of Sponsor, whose decisions, along with the decisions of Sponsor, will be final and binding in all matters relating to this Sweepstakes. Odds of winning a prize will be determined by the total number of eligible entries received through entry method. The awarding of the prize is subject to verification of potential Winners’ eligibility. The Winners will be notified on or around April 21, 2023, by direct message, and will be asked to provide a valid email address in order to complete required verifications and in order to receive the prize. The Winner will have 48 hours to respond to the initial direct message, and three (3) days to respond to  follow-up notification email to accept the prize. Before being declared a winner, unless prohibited by law, the potential Grand Prize Winners will be required to execute a declaration of Eligibility/Liability & Publicity Release (“Declaration”), sent with the e-mail notification in order to formally accept the prize as noted in the Prize section below.  If the Winner chooses to bring a guest (“Guest”), such Guest must meet all eligibility requirements contained in these Official Rules, including the age of consent, and will be required to execute a declaration of eligibility and liability/publicity release.  If any prize notification is returned as undeliverable, or if the potential Winner fails to complete the prize claim document within the stated time period, or if the potential prize Winner cannot accept the prize as stated, or if Sponsor, in its sole discretion, deems the potential Winner ineligible to receive the prize for any reason, the corresponding prize will be forfeited in its entirety and awarded (time permitting) to an alternate Winner in a random drawing from among the remaining entries received.

6. UNLESS OTHERWISE PROHIBITED BY LAW, SPONSOR’S AND/OR ADMINISTRATOR’S DECISIONS AS TO THE ADMINISTRATION AND OPERATION OF THE SWEEPSTAKES AND THE SELECTION OF POTENTIAL WINNER ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY AND THE POTENTIAL WINNING ENTRY HAVE BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREENSHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY ENTRY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED DEFECTIVE AND IS VOID AND WILL NOT BE HONORED.

7. Verification of Potential Winners
Potential Winner must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. Winner (and Guest, if any) must be the age of majority or older. The potential Winner will be required to provide Sponsor (or Administrator, if used) with documentation that shows they were an eligible participant. In the event that a potential Winner of a Sweepstakes prize is disqualified for any reason, Administrator may award the applicable prize to an alternate Winner by random drawing from among all remaining eligible entries. 

Unless otherwise prohibited by law, prizes are non-transferable, and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute any listed prize for one of equal or greater value for any reason. Any and all guarantees and warranties are subject to the manufacturer’s terms and conditions, and Winner agrees to look solely to such entity for any such warranty or guarantee claim. 

8. Prize
Grand Prize:
One (1) Grand Prize will be awarded. Winner will receive a trip for two (2) to Los Angeles, CA, from London Heathrow Airport, including roundtrip economy airfare, a hotel stay for five (5) nights (based upon double-occupancy), and a gift card for $200. If Winners are unable to travel during the relevant dates and times, they forfeit the prize.

Winners may select a Guest to travel with them.  Winners and guests must travel together on same itinerary, from London Heathrow Airport to Los Angeles International Airport, and must be able to travel on specific dates as determined by Sponsor/Administrator in their sole discretion. Blackout dates and other airline restrictions apply.  Winners and Guests are responsible for obtaining all necessary travel documents. Without limiting the foregoing, airports and hotel are of Sponsor’s sole choosing. Valid government identification is required for Grand Prize travel. Travel and lodging are subject to availability and other restrictions. All other expenses and costs, not expressly listed above, including, but not limited to, taxes, tips, entertainment, transfers between winner’s home and airport, as well as seat assignment or baggage fees determined by selected airline are Grand Prize winner’s sole responsibility. Other restrictions may apply. Sponsor is not liable for any expenses incurred as a consequence of flight cancellation/delay. All air transportation tickets are subject to the vagaries of flight variation, work stoppages and schedule or route changes. Winner is not entitled to any surplus between the actual retail value of the prize and the stated value.  Should any Winner choose to accept prize without a Guest for any reason, prize will be awarded in increments appropriate for a single traveler and no additional prize or compensation will be awarded. If, for whatever reason, Sponsor is unable to provide any prize element, no compensation or substitution will be provided, unless prohibited by law.

Travel must commence no later than December 31, 2024, and Winner must arrange travel through Sponsor at least 30 days in advance.  Information on how to contact Sponsor to arrange travel will be provided pursuant to release information.

The Released Parties are not liable in any way for damage or injury to Winner or Guest for any reason.  Winner and Guest hereby and must acknowledge that travel contains inherent dangers that include bodily harm and death.   Should Winner choose to accept prize without a Guest for any reason, prize will be awarded in increments appropriate for a single attendee and no additional prize or compensation will be awarded. If, for whatever reason, Sponsor is unable to provide any prize element, no compensation or substitution will be provided. 

In connection with travel related to any element or activity of the Grand Prize, please be advised that each prize element provider’s policies, CDC guidelines, and the recommendations of health officials must be followed. In addition, winner and guest should be aware of and comply with government guidelines regarding travel restrictions and mandatory quarantines before visiting any destination. Please note that any public location where people are present provides an inherent risk of exposure to COVID-19, and Sponsor and Administrator cannot guarantee that any person will not be exposed during a visit.

The approximate retail value (“ARV”) of Grand Prize is $6,200. Actual value may vary and Winner is not entitled to a difference between actual and estimated value. The total ARV is $12,400.

The prize offered and awarded are not redeemable for cash.  Prize details not specified herein shall be determined solely by Sponsor. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. 

9. Entry Conditions and Release
Except where prohibited by law, by entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of Sponsor and Administrator, which are binding and final in all matters relating to this Sweepstakes; (b) except where prohibited, release and hold harmless Sponsor, Administrator, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes, and all of their respective affiliates and related entities and each of their respective officers, directors, agents, vendors, employees and other representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, illness, death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Sweepstakes, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) except where prohibited, indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an entrant’s participation in the Sweepstakes and/or entrant’s acceptance, use or misuse of prize.

Any personally identifiable information collected during an entrant's participation in the Sweepstakes will be collected by Sponsor, Administrator or other Sponsor designee and used by Sponsor, its affiliates, designees, agents and marketers for purposes of the administration and fulfillment of the Sweepstakes as described in these Official Rules. 

10. Publicity
Except where prohibited, participation in the Sweepstakes constitutes Winner’s consent to Sponsor’s and its agents’ use of Winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any medium, worldwide, without further payment or consideration. 

11. General Conditions
Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, delayed, illegible, garbled or damaged entries, prize claims, email or mail; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries or prize claims, the announcement of the prize or in any Sweepstakes-related materials.  Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Administrator reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Administrator’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Administrator in its sole discretion. Upon cancellation or termination of the Sweepstakes for any reason, Sponsor and Administrator shall have no obligation to award prizes or compensation of any kind. Administrator reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Administrator reserves the right to seek damages from any such person to the fullest extent permitted by law. Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. 

Entry in the Sweepstakes constitutes an entrant’s full and unconditional agreement to abide by and accept the terms and conditions of these Official Rules. No substitution of prize or cash equivalent except at Sponsor’s sole discretion and as required by law. Cash equivalent may be less than the ARV of the prize. Prize is non-transferable except at the sole discretion of the Sponsor. All federal, state and local taxes on the prize are Winner’s sole responsibility. By accepting the prize, Winner waives the right to assert as a cost of winning said prize, any and all costs of redemption or travel to redeem said prize and any and all liability that might arise from redeeming or seeking said prize. 

Electronic Entries: In the event of a dispute, online entries will be deemed made by the authorized account holder of the email address submitted at time of entry. The authorized account holder is the natural person who is assigned to the email address by an Internet access provider, online service, or other organization that is responsible for assigning email addresses. Potential Winner may be required to show proof of being the authorized account holder. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. 

12. Limitations of Liability
The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; (d) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. One prize per person only. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.

13. Choice of Law and Disputes
By entering the Sweepstakes, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes shall be governed by laws of the State of California, except where prohibited, without giving effect to any choice of law or conflict of laws principles. By participating in the Sweepstakes, entrants consent to the jurisdiction and venue of the federal, state and local courts located in California, except that English residents may have additional protections available to them, which will be respected by Sponsor.

Except where prohibited, entrants agree that: (a) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

14. Entrant’s Personal Information
Information collected from entrants is subject to Sponsor’s Privacy Policy, which is available at https://www.discoverlosangeles.com/privacy-policy. Each entrant acknowledges that, by entering the Sweepstakes, entrant has opted into Sponsor’s Privacy Policy and, by opting into Sponsor’s Privacy Policy, has read and accepted Sponsor’s Privacy Policy. Sponsor uses commercially reasonable efforts to comply with CAN-SPAM guidelines.  Entrants may subsequently opt out of receiving further communications by following the instructions contained in the email communication.  Any complaints or concerns regarding this policy should be directed to contracts@latourism.com.  In all cases, entrants may subsequently opt out of any email communication by following the instructions contained in the email.
