Bravo’s Top Chef Food & Wine Festival Ticket Giveaway Sweepstakes Official Rules
PRELIMINARY INFORMATION: NO PURCHASE NECESSARY. A purchase will not improve your chances of winning. Void where prohibited. The Los Angeles Tourism Board FridayGiveaway Bravo’s Top Chef Food & Wine Festival Ticket Sweepstakes (“Sweepstakes”) will begin on March 6, 2020 at 10:00 AM PT and end on March 6, 2020 at 5:00 PM PT (“Sweepstakes Period”). All times in the Sweepstakes refer to Pacific Time (“PT”). Odds of winning depend upon the number of eligible Entries (as defined below) received. Sweepstakes is subject to all applicable federal, state and local laws. PRIZE (DEFINED BELOW) DOES NOT INCLUDE TRANSPORTATION, ACCOMMODATIONS, OR PARKING BEYOND THAT SPECIFIED BELOW.
ELIGIBILITY: The Sweepstakes is open to permanent, legal residents of the United States and the District of Columbia who are twenty-one (21) years of age or older at of the start date of the Sweepstakes Period. Officers, directors, and employees of Sweepstakes Entities (as defined below), members of these persons’ immediate families (spouses and/or parents, children, and siblings, and each of their respective spouses, regardless of where they reside), and/or persons living in the same households as these persons (whether or not related thereto) are not eligible to enter or win the Sweepstakes. Sweepstakes Entities, as referenced herein, shall include Los Angeles Tourism & Convention Board, 633 West 5th Street, 18th Floor, Los Angeles, CA 90071 (“Sponsor”), Universal City Studios LLC d/b/a Universal Studios Hollywood (“Universal Hollywood”), 100 Universal City Plaza, Universal City, CA 91608 (“Prize Provider”), and each of their respective parent, subsidiary, and affiliate companies, and their administrative, advertising, and promotion agencies, and any other entity involved in the development, administration, promotion, or implementation of the Sweepstakes.
TO ENTER: Online entry only. To participate, Entrants must have a public Instagram account in good standing and agree to their Terms of Service and Privacy. Creating an Instagram account is free. Entrants may create an Instagram account by accessing Instagram at www.instagram.com and following the instructions to create an account for free. During the Sweepstakes Period, Entrants must 1) follow LATCB and Universal Studios Hollywood at @discoverla and @unistudios, respectively; 2) and tag one friend in the comments section on the Friday, March 6, 2020 post (collectively, “Entry”). Negative comments or posts will be disqualified. If you choose to submit an Entry via your web-enabled mobile device, data rates may apply. See your wireless service provider for details on rates and capabilities. All Entries become the property of Sponsor and will not be acknowledged.
Limit one (1) entry per Instagram account.
All Entries must be received no later than 5:00 p.m. PT on March 6, 2020 to be eligible for the Sweepstakes. Sponsor’s computer shall be the official timekeeper for all matters related to this Sweepstakes. Entries that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted. In case of a dispute over the identity of an entrant, the authorized account holder of the Instagram account used to enter will be deemed to be the entrant. “Authorized account holder” is defined as the person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Entry constitutes permission (except where prohibited by law) to use entrant’s name, city, state, likeness, image, and/or voice for purposes of advertising, promotion, and publicity in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval.
PRIVACY: All personal information collected by Sponsor will be used for administration of the Sweepstakes. In addition, Entrants may receive email correspondence from, or on behalf of Sponsor subject to Sponsor’s privacy policy. Sponsor uses reasonable commercial efforts to comply with Federal CAN-SPAM guidelines and to supply information to entities that comply with CAN-SPAM guidelines, and Entrants may subsequently opt-out of receiving further emails by following the opt-out instructions contained in the email. Any questions regarding privacy matters should be directed to the address set out below. Please refer to Sponsor’s privacy policy located at https://www.discoverlosangeles.com/privacy-policy for important information regarding the collection, use and disclosure of personal information by Sponsor.
WINNER SELECTION AND NOTIFICATION: On or about March 6, 2020, one (1) potential winner (“Winner”) will be selected in a random drawing by representative of Sponsor from all eligible Entries received during the Sweepstakes Period. Each Sweepstakes entry will be entered into a random drawing by a representative of Sponsor from among all eligible entries received during the Sweepstakes Period. The Winner will be notified via direct message on the Instagram account used to enter the Sweepstakes within twenty-four (24) hours of drawing date. The Winner will be required to respond (as directed) within two (2) business days of attempted notification. Winner’s failure to respond in a timely fashion to the notification may result in forfeiture of the prize, and in such case, Sponsor may randomly select an alternate Winner from among the remaining eligible entries, up to four (4) times. The Winner may be sent a declaration of eligibility / liability / publicity release (“Release”). Except where prohibited by law, the Release will state that Winner agrees to allow Sponsor to use (without additional compensation) their name, address, photograph, testimonial, likeness and/or biographical information for purposes of advertising and promotion (including, without limitation, posting on Sponsor’s website(s) and affiliated website(s)). Winner may also be required to provide name, U.S. Social Security Number (for tax form purposes), birth date, current address, and phone number. Unless restricted by law, the Winner will be required to complete and return the Release within the time period specified therein. Winner will receive the prize within approximately twelve (12) days of notification (exact timing subject to change based upon availability of prize). Sponsor shall not be responsible for lost, destroyed, misdirected, or incomplete Releases. The prize may be forfeited, and in such case, an alternate Winner may be randomly selected from among the remaining eligible entries if the Selected Entrant: (i) cannot be reached; (ii) does not respond to the notification in a timely manner as required pursuant to these Official Rules; (iii) fails to obtain all signatures on the Release and to return the documents in a timely manner as required pursuant to these Official Rules; or (iv) cannot accept or receive the prize for any reason. Non-compliance with these Official Rules may result in disqualification and selection of an alternate Selected Entrant. Sponsor may not make multiple attempts to contact Selected Entrant.
PRIZE: There will be one (1) prize awarded (“Prize”) awarded to Winner. Prize will consist of the following: Two (2) General Admission tickets to Bravo’s Top Chef Food & Wine Festival (“Tickets”) at Universal Studios Hollywood on March 19, 2020. Tickets do not include admission to the park during the day. Bravo’s Top Chef Food & Wine Festival is a separately ticketed event which runs from 7pm – 10:30pm on Thursday, March 19, 2020, and Friday, March 20, 2020. Must be 21 years or older with valid photo ID to attend. Event occurs rain or shine. Dates, times, and entertainment are subject to availability and may change without notice. Other restrictions may apply. The Estimated Retail Value (“ERV”) of the prize is Three Hundred and Fifty and 00/100 Dollars ($350.00). Actual Retail Value (“ARV”) of Prize may vary. Any difference between ERV and ARV will not be awarded. For any Prize with an ARV of six hundred dollars ($600.00) or greater, Sponsor will furnish an Internal Revenue Service Form 1099 to Winner for the ARV of Prize for the year in which Prize was won.
In the event the winner is unable to travel on the dates specified in the Official Rules to attend Bravo’s Top Chef Food & Wine Festival at Universal Studios Hollywood on Thursday, March 19, 2020, the prize will be forfeited without further or alternative compensation. Prize Provider will not replace any lost, mutilated, or stolen tickets. Winner must be 21 years of age or older. Prizes are non-transferable and no substitution will be made except as provided herein at the Prize Provider’s sole discretion. Prize Provider reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use.
PRIZE CONDITIONS: No substitution, transfer, or cash redemption of prize permitted, provided however that Sponsor reserves the right to substitute a prize with another prize of equal or greater value should the advertised prize becomes unavailable for any reason. Winner cannot assign or transfer their prize to another person or business. All activities related to the prize are at the Winner‘s own risk, as defined below, and subject to whatever restrictions are imposed by the entities that govern such activities. If prize notification or any prize is returned as undeliverable, or if Winner may not accept or receive a prize for any reason, prize will be forfeited.
All federal, state or other tax liabilities (including income taxes) arising from the Sweepstakes will be the sole responsibility of Winner. The Sweepstakes is subject to all applicable federal, state and local laws of the United States. By participating, Winner agrees to be fully and unconditionally bound by the Official Rules and Sponsor’s decisions and waives any right to claim ambiguity in the Sweepstakes or the Official Rules. Winner also agrees to release, discharge, indemnify and hold harmless Sweepstakes Entities, and its officers, directors, employees, representatives and agents (collectively “Released Parties”) from and against any claims, damages, disability, attorneys' fees, and costs of litigation and settlement, as well as any liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from: (i) use, redemption, acceptance, possession, ownership, or misuse of any prize, (ii) participation in any activity, event, or excursion offered in connection with the prize, (iii) use of any facility, service and/or accommodation related to the prize, or (iv) participation in any Sweepstakes-related activity or participation in the Sweepstakes. Sponsor reserves the right to disqualify any entrant it finds to be tampering with the entry process or the operation of the Sweepstakes or violating these Official Rules, and reserves the right at its sole discretion to terminate the Sweepstakes and, if terminated, at its discretion, select the potential winner(s) in a random drawing from among all eligible, non-suspect entries received prior to action taken. Sponsor shall not be liable for: (i) late, lost, delayed, void, corrupted, misdirected, incomplete unreadable, inaccurate, garbled or unintelligible entries, communications or declarations, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical malfunctions, bugs, lost connections, disconnections, delays or transmission errors entrants may encounter when submitting their entry; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Sweepstakes; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Sweepstakes. Caution: any attempt to deliberately damage or undermine the legitimate operation of the Sweepstakes may be in violation of criminal and civil laws and will result in disqualification from participation in the Sweepstakes. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages (including attorney fees) to the fullest extent of the law, including criminal prosecution.
DISPUTES: Disputes regarding the Official Rules and/or the Sweepstakes will be governed by the internal laws of the State of California. By entering the Sweepstakes, Entrant consents to jurisdiction in the federal and state courts of California for the resolution of any and all disputes.
WINNER ANNOUNCEMENT: For a copy of these Official Rules or of the winner(s), send your request in a self-addressed, stamped envelope (WA and VT residents need not affix return postage) to: Los Angeles Tourism & Convention Board, 633 West 5th Street, 18th Floor, Los Angeles, CA 90071. Request must be received within 90 days of the end of the Sweepstakes. Winner(s) will be announced on the @discoverLA Instagram account in the comments section of the Sweepstakes post.
PRIZE PROVIDER: Universal City Studios LLC dba Universal Studios Hollywood.
Universal Studios Hollywood is a prize provider only in this Sweepstakes; is not a sponsor of this Sweepstakes; and are not responsible for the administration of the Sweepstakes, the collection of the entries or the conduct of the draws. Notwithstanding the foregoing, all disputes arising out of or relating to any person’s use of, or participation in, the prize itself shall be resolved by applying the laws of California, without regard to conflict of laws provision therein, and shall be solely and exclusively brought in state or federal courts within California. Such claims shall be resolved individually, without resort to any form of class action, and all such claims shall be limited to actual out-of-pocket costs incurred, but in no event to include attorneys’ fees.
The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Instagram. Entrants are providing information to Sponsor and not to Instagram. The information Entrants provide will only be used for administering the Sweepstakes and for marketing purposes in accordance with Sponsor’s privacy policy, located at https://www.discoverlosangeles.com/privacy-policy.
